THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.22207 of 2008 ORDER:

The proceedings under challenge in this writ petition is a notice dated 25.09.2008 issued by the Tahsildar directing the Mandal Revenue Inspector to inspect the subject land on 29.09.2008. By order dated 10.10.2008 this Court directed the parties to maintain status quo. While the interim order was passed on 10.10.2008, the date of the survey was even prior thereto on 29.09.2008. It is not known whether or not the survey was conducted. Be that as it may, since the notice itself was for conducting a survey on 29.09.2008, more than eight years ago, it is evident that the cause in the writ petition does not survive and the writ petition has become infructuous. The Writ Petition is, accordingly, dismissed as infructuous. Needless to state that, in case the respondent initiates proceedings to conduct a survey afresh, it is always open to the petitioners to question the same in appropriate legal proceedings. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
