HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.1852 OF 2017 ORDER:
The present Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by respondent Nos.2 to 4 in D.V.C.No.23 of 2016 on the file of Additional Judicial Magistrate of First Class, Gajwel, requesting to quash the proceedings in the said D.V.C. against them.
2. Petitioners are the parents - in - law and brother - in- law, respectively, of respondent No.2 - de facto complainant. Respondent No.2 filed the aforesaid D.V.C., under Section 12(1) of Protection of Women from Domestic Violence Act, 2005, seeking certain reliefs, which have been mentioned at page No.10 of the material papers.
3. Heard Ms. Ch. Vijaya Lakshmi, learned counsel appearing on behalf of Sri E. Phani Kumar, learned counsel for the petitioners, and learned Additional Public Prosecutor for the State of Telangana.
4. Learned counsel for the petitioners confines the request to the extent of dispensing with the presence of petitioners herein in D.V.C.No.23 of 2016 on the file of Additional Judicial Magistrate of First Class, Gajwel.
5. The request appears to be reasonable, for the reason that there appears to be yet another case against the petitioners and husband of
respondent No.2 for the offences punishable under Section 498-A I.P.C. and Sections 3 and 4 of Dowry Prohibition Act on the file of very same Court, may be at crime stage. Therefore, the request of the learned counsel for petitioners to that extent is acceded to dispensing with the presence of petitioners herein in D.V.C.No.23 of 2016 on the file of Additional Judicial Magistrate of First Class, Gajwel, but, however, they shall attend the Court below as and when directed by the learned Magistrate, in case of necessity, and respondent No.1 in the D.V.C. shall represent the petitioners herein.
6. With the above direction, the Criminal Petition is disposed of. Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
