HONOURABLE SRI JUSTI CE SANJAY KUMAR CRI MI NAL PETI TI ON No.1881 OF 2019 O R D E R:

The petitioners are A.9 and A.10 in Crime No.546 of 2018 registered on the file of Keesara Police Station, Rachakonda District, under Sections 379 IPC and Section 15 (2) of PPLA-Amendment Act, 2011. By way of this petition filed under Section 438 Cr.P.C. they seek anticipatory bail. Earlier A.9 filed Crl.P.No.1168 of 2019 before this Court seeking anticipatory bail and this Court dismissed the same, vide order dated 12.3.2019, holding to the effect that the allegations levelled against him were grave in nature and under the said circumstances, he was not entitled to anticipatory bail.

Having suffered such an order, the present petition was filed without disclosing the factum of dismissal of Crl.P.No.1168 of 2019. The learned Assistant Public Prosecutor, having produced a copy of the aforestated order in Crl.P.No.1168 of 2019, would further state that the allegations levelled against the petitioners are serious in nature and grant of regular bail to some of the accused in the case would not be reason enough for this Court to grant anticipatory bail to these accused. For the aforestated reasons and considering the fact that this Court has already held that A.9 is not entitled to anticipatory bail, no grounds are made out for entertaining this petition.

The Criminal Petition is accordingly dismissed. ____________________ JUSTI CE SANJAY KUMAR April 15, 2019.
