THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.45547 OF 2016 ORDER:

The case of the petitioner is that she got executed General Power of Attorney (GPA) in favour of the 3rd respondent on 02.08.2011. Since the 3rd respondent is misusing the power, the petitioner intended to cancel the same and presented a document of cancellation of GPA dated 07.09.2016 before the 2nd respondent. Having received the document presented by the petitioner, the 2nd respondent kept pending without registering the same. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. Having received the document presented by the petitioner, the 2nd respondent has to register the same, if the same is in order as per the provisions of the Stamps and Registration Act, 1908 (for short 'the Act') and the Rules made thereunder and if he wants to refuse the registration of document, he has to record reasons for refusal as per Section 71 of the Act.

In view of the same, the 2nd respondent is directed either to register the document presented by the petitioner on 07.09.2016, if the same is in order as per the provisions of the Stamps and Registration Act and the Rules made

thereunder and if he wants to refuse the same record the reasons for refusal as per Section 71 of the Registration Act and communicate the same to petitioner.

With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 27.12.2016 dv
