THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.2259 OF 2018 ORDER:

This petition is filed by the petitioners-A1 to A3 under Section 482 Cr.P.C. to quash the proceedings in PRC No.9 of 2015 on the file of the III Addl. Judl. Magistrate of I Class, Kakinada, which has taken cognizance of the offences punishable under Sections 302 r/w 34, 109 and 120-B IPC. 2.

Heard the learned counsel for the petitioner, learned Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner would submit that police filed charge sheet eliminating the petitioners-A1 to A3. Thereafter, on a protest petition, the learned Magistrate has taken cognizance of the offences referred above and the same was numbered as PRC No.9 of 2015. 4.

The petitioners-A1 to A3 can put their all defences for discharge. If required, they can also file an application under Section 239 Cr.P.C.

Without expressing any opinion on the merits of the case, by granting liberty as indicated above, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
