O R D E R
This writ petition is filed seeking writ of mandamus declaring the action of the respondents 1 to 8 in allowing the 9th respondent to quarry the sand in respect of Chinnachigullarevu sand reach, Chitravathi River bed situated at Chinnachigullarevu Village, Tadimarri Mandal, Anantapur District, as illegal, arbitrary and contrary to the 9B (6) of A.P. Minor Mineral Concession Rules and Section 27 of Andhra Pradesh Water, Land and Trees Act, 2002 and Rule 23 of Andhra Pradesh Water Land and Trees Rules, 2004 and for a consequential direction to the respondents not to allow any sand quarrying operations in respect of Chinnachigullarevu sand reach, Chitravathi River bed, Tadimarri Mandal, Anantapur District.
The case of the petitioner is that the 9th respondent is carrying on activity of quarrying sand at Chinnachigullarevu sand reach, Chitravathi River, Tadimarri Mandal, Anantapur District, contrary to 9B
(6) of A.P. Minor Mineral Concession Rules and Section 27 of Andhra Pradesh Water, Land and Trees Act, 2002 and Rule 23 of Andhra Pradesh Water Land and Trees Rules, 2004 and also in violation of interim order passed in W.P.No.18822/2011 dated 21.03.2012. When the matter came up for hearing on 28.01.2015, the learned Special Government Pleader submitted that W.P.No.18822/2011 itself disposed of on 22.12.2014 and sought time. Today, when the matter is listed, he produced a letter dated 27.01.2015, which shows that the permission was granted to the 9th respondent for quarrying the sand. In view of the letter dated 27.01.2015 produced by the Special Government Pleader showing the permission granted to the 9th respondent for quarrying the sand and in view of the order passed by this Court in W.P.No.18822 of 2011 asking the State Government of Andhra Pradesh to look into the problem of quarrying of sand in any
manner and also modifying the interim order dated 21.02.2012, this writ petition is disposed of. No order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
