Binniboina Penchalaiah v. The State Of Andhra Pradesh
HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 44232 of 2016 ORDER:
1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is being taken up for disposal at the admission stage itself.
2) The present writ petition came to be filed seeking issuance of writ of mandamus directing the respondents to survey the land admeasuring Ac.21.49 cents in Sy.No.617, 619, 620 and 621 of Bogodu Village and Mandal, SPS Nellore District and fix the boundaries.
3) Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the fifth respondent to consider his representation dated 30.11.2016. It is his case that though an application was made on 30.11.2016 enclosing copies of 1-B and pattadar pass books, till date no survey is conducted.
4) The Government Pleader for Revenue submits that if the said application is still pending consideration, the authorities may be directed to consider the said representation in accordance with law.
5) Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ
petition is disposed of, directing the fifth respondent to dispose of the representation dated 30.11.2016, in accordance with law, as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of the order, if the same is made and still pending consideration. No order as to costs. 6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
