THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION Nos.5620 & 2947 of 2003 COMMON ORDER:

Since the issue raised in these two writ petitions is one and the same, both the writ petitions are heard together and disposed of by this common order.

When the matters are taken up for hearing, learned counsel for the petitioners contended that the petitioners have challenged the orders of termination issued by the Chinmaya Trust which was running School of DAV institutions and that the DAV institutions have deposited the entire terminal benefits in petitioners' Bank Account to the effect of services rendered with Chinmaya Trust, which will not be counted for the purpose of terminal benefits. Learned counsel for the petitioners submits that petitioners are on the verge of retirement and no further orders are necessary and the writ petitions may be closed. He further submits that if the petitioners are aggrieved by any non-payment of terminal benefits, they may be permitted to challenge the same in an appropriate forum. This Court, having considered the rival submissions made by both the parties, is of the considered view that no further orders are necessary in both the writ petitions.

Accordingly, both the writ petitions are closed. However, liberty is given to the petitioners to pursue their remedies, if at all they are aggrieved by the non-payment of terminal benefits by the respondents. No order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
