THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.42333 of 2015 ORDER:

The grievance of the petitioner is that the mining authorities are not taking action to process his application for grant of a mining/quarry lease in respect of the mineral, Laterite, over an extent of Ac.153.37 cents in Sy.Nos.1,2,3,4 and 5 of Anumarthi Village, Sankavaram Mandal, East Godavari District.

According to the petitioner, the Tahsildar, Sankavaram Mandal, has already issued a report on 11.08.2008 certifying the availability and suitable classification of the subject land for grant of a mining lease and despite the timeframes fixed for processing such applications under G.O.Ms.No.181, Industries and Commerce (Mines-I) Department, dated 28.05.1998, the mining authorities are not taking necessary action. In the facts and circumstances of the case as stated above, this Court finds no justification on the part of the respondent authorities in not taking any steps on the application of the petitioner for grant of a mining lease submitted as long back as on 08.08.2005. Therefore, this Court is of the considered opinion that ends of justice would be met if a direction is given to the respondents to consider the application of the petitioner and take an appropriate final decision thereon in accordance with law within a timeframe.

The writ petition is accordingly disposed of directing the respondent authorities to take appropriate action as per law on the application dated 08.08.2005 filed by the petitioner for grant of mining lease within a period of four months from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 22nd January, 2016 IBL
