THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6079 of 2018 ORDER:

The petitioner states that she was issued D-form patta on 07.05.2004 in respect of land admeasuring Ac.0.40 cents forming part of R.S.No.119/1 situated at Uppalapadu Village, Kamavarapu Kota Mandal, West Godavari District. Subsequently she was also issued pattadar pass books and title deeds and she has been in possession of the said land by cultivating the same. While so, the fourth respondent issued a notice dated 21.09.2017 under Section 7 of the Andhra Pradesh Land Encroachment Act. The petitioner submitted her explanation on 25.09.2017 and without passing any order, when there is a threat of dispossession, the present Writ Petition is filed.

In view of the above, this Court is not inclined to interfere with the proceedings at this stage, but directs the fourth respondent to communicate a copy of the final order to the petitioner, if an order is already passed. If no final order is passed, the fourth respondent is directed to pass appropriate orders by considering the explanation of the petitioner dated 25.09.2017, and till the final order is passed, the land in possession of the petitioner shall not be interfered.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
