THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION NO.1072 OF 2015 ORDER:

This civil revision petition is filed under Article 227 of the Constitution of India, challenging the order in I.A.No.68 of 2012 in F.C.O.P.No.119 of 2010 dated 19.01.2015 passed by the IV Additional District and Sessions Judge, Kurnool, whereby, the petition filed under Section 5 of the Limitation Act to condone the delay of 441 of days in filing the petition to set aside the ex parte decree, was allowed.

However, the petition filed under Order IX Rule 13 of Code of Civil Procedure to set aside the ex parte decree was dismissed as not pressed on 01.07.2015. Hence, nothing remains to be examined by this Court in the revision. Therefore, the revision petition is dismissed as infructuous. No costs. The miscellaneous petitions pending, if any, shall also stand closed.
