HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.21200 of 2011 ORDER:

The action of the respondents in interfering with the erection of a tower in the house outside Lal Darwaza, Hyderabad by the petitioner company, allegedly at the behest of respondents 3 to 8, is questioned in this Writ Petition as being arbitrary and illegal. While the petitioner claims to have submitted an application, and to have proceed with construction on the ground that no response was forthcoming from the GHMC for more than 30 days, the complaint in this Writ Petition is that the GHMC was interfering with the tower erected by the petitioner, at the instigation of respondents 3 to 8, without putting them on notice. Suffice it, therefore, to dispose of the Writ Petition directing the GHMC not to take any coercive steps to demolish the subject tower except after putting the petitioner on notice and after giving them an opportunity of being heard.
