THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 673 OF 2017 ORDER :

This Contempt Case is filed alleging violation of the order passed by this Court on 29.03.2016 in W.P.No.10111 of 2016. 2.

Taking into consideration the allegations made against the 6th respondent in the Writ Petition, particularly, taking note of the allegation that the 6th respondent had erected a gate, which is causing obstruction to the road, the Writ Petition was disposed of directing the respondents to act on the representation of the petitioner and take necessary action, if the violations are found to be true.

Now, a counter-affidavit is filed by the 2nd respondent, the Divisional Panchayat Officer, Amalapuram, stating that pursuant to the orders of this Court, notices were issued to the 6th respondent and after issuance of notice, the 6th respondent had in fact removed the gate and thereby, the grievance of the writ petitioner stand redressed.

In support of the specific assertion, the 2nd respondent has filed photographs evidencing existence of the gate before removal as well as after removal. 4.

In the light of the specific assertion in the counter-affidavit, which was not refuted by way of filing reply affidavit, the Contempt Case is closed as the order of this Court has been complied with.
