The petition coming on for hearing, upon perusing the Petition filed in support thereof and upon hearing the arguments of Sri Rapolu Bhaskar Advocate for the Petitioners and Public Prosecutor for the Respondent, the Court made the following. ORDER:
THE HONOURABLE JUSTICE G. SRt DEVI CRIMINAL PETITION No.2372 of 2O2O ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioners/A- 1 and A-2 seeking to grant anticipatory bail in the event of their arrest in connection v,'ith FIR No.207 0f 2020 0f sHo, Kodad Police station, Kodad Tou,n, Nalgonda District, which was registered for the offences punishable under Sections 419 and 420 of lPC. Hezrrd learned counsel appearing for the petitioners/A-1 and A-2, learned Public Prosecutor appearing for the respondent- State and perused the record. Learned counsel for the petitioners contends that A-1 is the owner of the Medical Shop and Clinic and A-2 is a RMP Doctor, who is working in the said Clinic. Due to the business rivalry, the defacto complainant has lodged the present complaint against the petitioners to implicate them in a false case.
It is also contended that there was no complaint either by any patient or by Dr. Kanuri Rajashekar against the petitioners. The petitioners apprehend that they may be arrested in connection with the above crime and they are ready to cooperate with the investigation, if they are released on anticipatory bail.
Learned Public Prosecutor opposed to grant anticipatory bail to the petitioners/A-1 TO O-r.
Crl P.N0.2372 0f2020 A perusal of the record shows that none of the victims or patients made any complaint against the petitioners and even there was no complaint made by Dr. Kanuri Rajashekar against the petitioners and the present complaint is lodged against the petitioners only basing on the directions issued by the superior officers.
Therefore, looking into the nature of allegations levelled against the petitioners/A-1 and A-2 and also having regard to the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners/A-1 and A-2. Accordingly, this Criminal Petition is allowed and the petitioners/A-1 and A-2 are granted anticipatory bail subject to the following terms and conditions:
(i) The petitioners/A-1 and A-2 are directed to surrender before the SHO, Kodad Police Station, Kodad Town, Nalgonda District, within a period of ten (10) days from the date of this order and on such surrender, the said Station House Officer shall release the petitioners/A- i and A-2 on bail on their executing separate personal bonds for a sum of Rs. 15,000/- (Rupees fifteen thousand only) each with two sureties for a like sum each to his satisfaction.
(2) The petitioners/A- 1 and A-2 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and cooperate with the Investigating Officer in investigating the case.
