Smt Gampa Anasuryamma, W/o.Late Narayanareddy, Aged about 65 yrs, Occu : Agriculture, R/o.Sompalli Village, Burgampahad Mandalam, Khammam District, Presently Bhadradri Kothagudem District ..
Petitioner And The State of Telangana, Rep., by Principal Secretary, Revenue Department, Secretariat, Hyderabad & others .. Respondents This court made the following :
- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.28294 OF 2017 ORDER :
Heard.
2.
Petitioner claims that her family owns land to an extent of Ac.28-00 in several survey numbers of Sompalli Village, Burgampahad Mandal, mentioned in her representation dated 11.08.2017. As she is old aged, she wanted to mutate the names of her children in the revenue records and therefore, voluntarily submitted representation to the Tahsildar on 11.08.2017 to mutate the names of her children in the revenue records. Alleging inaction on the said representation, this writ petition is filed. 3.
Two things to be noted herein are firstly A.P. Rights in Land and Pattedar Pass Books Act 1971 (for short 'the Act, 1971'), envisages a detailed procedure for altering the revenue records/mutation of names in the revenue records or issuing of pattedar pass book and title deeds, if any; and secondly for correction in the revenue records and for entering the names in revenue records concerning the subject property, the parties should submit an application to the Tahsildar in Form 6-A appended to the Rules, for entering their names. But so far, no such application is filed. Based on a representation, the Tahsildar cannot act upon for undertaking corrections, when the Act, 1971 envisages particular procedure.
4.
Thus, leaving it open to the children of the petitioner to submit an appropriate application as required by law, for entering of their names in the revenue records concerning the subject properties mentioned in the representation stated to have been
- 3 - submitted by the petitioner, on 11.08.2017 addressed to the Tahsildar, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
