This Criminal Petition is filed under Sec.438 Cr.P.C. seeking anticipatory bail in the event of arrest of the petitioner/accused in Crime No.132 of 2015 on the file of Kakinada II-Town Police Station, East Godavari District, registered for the offences punishable under Sections 420 and 471 IPC.
The allegation is that the petitioner/accused has applied for a job in the Government Department with the help of fake degree certificate, which is said to have been issued by Chandra Shekar Azad University of Agriculture & Technology.
Heard the learned counsel for both sides.
The learned counsel for the petitioner contends that the petitioner was not aware that the degree, which has obtained by him, was fake. On the other hand, the learned Public Prosecutor submits that the petitioner knowing fully well that the decree obtained by him is of bogus and fake when he applied for job and tried to deceive the Government Department.
Considering the nature of allegations, it is felt that it is not a fit case where the extraordinary relief of anticipatory bail can be granted. Hence, I see no merits in the petition and the same is liable to be dismissed.
In the result, the Criminal Petition is dismissed. Miscellaneous Petitions, pending if any in this Criminal Petition, shall stand closed.
