HONOURABLE SRI JUSTICE P. KESHAVA RAO CRIMINAL PETITION No.2374 of 2020 ORDER:

Heard learned counsel for the petitioner as well as learned Public Prosecutor.

The present criminal petition is filed to quash the proceedings in Crime No.551 of 2019 of Keesara Police Station, Rachakonda Commissionerate, registered for the offences under Sections 406, 420 and 506 IPC.

During the course of hearing, it is brought to the notice of this Court by the learned Public Prosecutor that accused No.6 in the present crime approached this Court by way of filing a criminal petition to quash the proceedings in Crime No.551 of 2019 of Keesara Police Station. This Court disposed of the said criminal petition by directing the first respondent police to follow the mandatory procedure as contemplated under Section 41-A Cr.P.C. 4.

Having heard both the counsel and from the perusal of the material on record, it is revealed that the investigation is still in progress. When the investigation is in progress, this Court is not inclined to grant any interim order stalling the investigation. 5.

Accordingly, the criminal petition is disposed of directing the first respondent police to follow the mandatory procedure as contemplated under Section 41-A Cr.P.C. and also the guidelines

issued by the Hon'ble Apex Court in Arnesh Kumar vs. State of Bihar1.
