THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.30912 OF 2011 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue a writ or writs more appropriately a Writ of Mandamus, declaring the action of the Respondent No.4 interfering in legal construction work of mosque in premises of Dargah Hazrath Kale Shah (RH), situated at Petla Burj, Hyderabad is illegal, void, ultra vires and in violation of principles of natural justice in the interest of justice."
2. Heard Sri Abdul Muqeeth Qureshi, learned counsel, appearing for the petitioner and learned Government Pleader for Home, appearing for the respondents.
3. Counter affidavit is filed by the Inspector of Police, Charminar Police Station, Hyderabad and at Paragraph No.9 of the said counter, it is stated that the respondent never interfered in the legal construction work of Mosque in premises of Dargah Hazrath Kale Shah (RH), situated at Petal Burj, Hyderabad, at any point of time.
3. While referring to the same, it is requested by learned counsel for the petitioner to dispose of the writ petition in view of the said averments in the counter affidavit.
4. In view of the above submission, writ petition is disposed of, in the light of the averments made at Paragraph No.9 of the counter affidavit filed by the Inspector of Police, Charminar Police Station, Hyderabad.
