Heard learned counsel for the petitioners and Government Pleader for Roads and Buildings.
Petitioners seek issuance of a Writ of Mandamus declaring the action of the respondents in trying to dispossess the petitioners from their land to an extent of Ac.0.13 cents in Sy.Nos.720/1 & 722/2 which belongs to 1st petitioner and house bearing No.5-212 situated in Sy.No.720/4 in Ac.0.04 cts which belongs to 2nd petitioner situated at Tunduru Village, Bheemavaram Mandal, West Godavari District, for the purpose of widening of road without issuing any notice or any land acquisition proceedings. Petitioners contended that this action is illegal, arbitrary and violative of principles of natural justice and seek a direction to the respondents not to demolish the petitioner's house without following due process of law.
Though various grounds are raised learned counsel for the petitioners restricts his prayer to seeking a direction to the respondents to follow due process of law.
Having regard to the facts and circumstances of the case and without going into the merits of the case, the present writ petition is disposed of, directing the respondents not to interfere with the subject
MSR,J W.P.No.32698 of 2016 property in the context of road widening except in accordance with the due procedure laid down by law. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
