HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No. 16769 of 2016 ORDER:
Vide present Criminal Petition, the petitioner/accused seeks anticipatory bail in the event of his arrest in connection with Crime No.210 of 2016 registered on the file of Station House Officer, Police Station, Charminar, Hyderabad for the offences punishable under Sections 406 and 420 IPC.
It is not in dispute that apart from the petition for anticipatory bail filed before the Sessions Court, the petitioner filed Writ Petition No. 38385 of 2016 before this Court seeking stay of his arrest. However, later on, he withdrew the said Writ Petition on 06.12.2016. Failing to obtain the relief sought for in the aforesaid Writ Petition, he filed the present Criminal Petition. The present crime was registered on the complaint lodged by the de facto complainant stating that he gave 1700 grams of gold to the petitioner, who promised him to pay the money by evening of the same day, but the petitioner did not return the money. Thereafter, though the de facto complainant contacted over phone, the petitioner neither return the money nor gold to him. Not only that, in respect of four other persons as mentioned in the complaint, the petitioner took gold from them and did not return money as promised to them. The petitioner thus cheated the de facto complainant as well as four other persons. In view of
the same, custodial interrogation of the petitioner is necessary for the police to investigate the crime.
For the foregoing discussion, I am not inclined to grant bail. The Criminal Petition is dismissed.
