Heard counsel for petitioner and Mr.Ramachandra Reddy for respondents 1 and 2.

The petitioner makes out twin grievances namely, in not taking action against alleged illegal construction raised by respondent No.3 on Plot No.7 (H.No.3-105/ 2/ 2) in an extent of 244 square yards at Boduppal Village, Ghatkesar Mandal, Ranga Reddy District, as illegal and secondly non-consideration of representations dated 07.12.2012 and 10.12.2012 amounts to refusing exercise of jurisdiction conferred on respondents 1 and 2 by Panchayat Raj Act.

The counsel for respondents 1 and 2 submits that construction since has been stopped, the respondents have to formally pass an order and submits that the authorities can be directed to dispose of the representations if the representations are still pending with them.

Having regard to above submissions the writ petition is disposed of by this order:

Respondents 1 and 2 are directed to dispose of the representations within eight weeks from the date of receipt of a copy of this order and prevent illegal construction, if any, being undertaken by 3rd respondent. It is brought to the notice of the Court that Boduppal Village Gram Panchayat is upgraded as Nagar Panchayat. The up-gradation is a case of merger and the

petitioner is given liberty to resubmit the representations by enclosing copy of this order to Nagar Panchayat for appropriate action.
