HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7095 of 2017 ORDER:

Though, learned counsel for the petitioner is not prepared to argue the matter on merits, a perusal of the complaint and the copy of the cheque in question filed along with the quash petition and the grounds urged in the quash petition are crystal clear that A2 and A3 are drawers of the cheque of A1-entity. Once such is the case, there is nothing to interfere, but, all the defences available to face the trial can raise before the trial Court.

Accordingly, the Criminal Petition is dismissed for no merits. The petitioners are at liberty to file an application under Rule 37 of the Criminal Rules of Practice for one to represent others, it is for the learned Magistrate to consider and permit, after hearing.
