The Court made the following:
ORDER:
This Writ Petition is filed for the following substantive relief :
" ... to issue any appropriate writ, order or direction, more particularly one in the nature of a writ of mandamus declaring the action of respondent No.8 Gram Panchayat proposal for establishing a Vegetable Market in petitioner site as arbitrary, illegal and violative of principles of natural justice ..." After arguing the case, Mr. C.S.N. Raju, learned Counsel for the petitioner, realised that as the question of title over the land claimed by the petitioner arises in the Writ Petition, the appropriate remedy for his client is to file a comprehensive civil suit for declaration of her title. He has therefore requested for permission to withdraw the Writ Petition with liberty to his client to file a civil suit. The Writ Petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to the dismissal of the Writ Petition, WPMP Nos27560 and 29247 of 2014 are dismissed as
infructuous.
