THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.15776 OF 2017 ORDER:

The grievance of the petitioner in the present Writ Petition is the alleged inaction on the part of the 2nd respondent-Joint Collector in passing appropriate orders on the Appeal and stay application, dated 17.11.2016, filed by the petitioner herein, against the order of cancellation of fair price show authorization of the petitioner, dated 04.11.2016, passed by the Revenue Divisional Officer, Ongole.

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies for the respondents. 3.

According to the learned counsel for the petitioner, the very inaction on the part of the 2nd respondent is highly illegal and arbitrary and the said facts and circumstances of the case do not warrant the extreme cancellation of authorization of the petitioner. 4.

On the other hand, it is submitted by learned Government Pleader that since the variations are very high, the respondents are perfectly justified in cancelling the authorization of the petitioner herein.

Since the appeal filed by the petitioner is admittedly pending before the 2nd respondent-Joint Collector, this Court is of the opinion that the ends of justice would be served, if the 2nd respondent-Joint Collector is directed to pass appropriate orders on the Appeal, dated 17.11.2016, filed by the petitioner herein, against the order of cancellation, dated 04.11.2016, within a

period of two weeks from the date of receipt of a copy of this order, after giving notice and opportunity to the petitioner. 6.

With the above observation, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. __________________ A.V.SESHA SAI, J APRIL 27, 2017 Note:
