THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.22546 of 2016 O R D E R:

Heard counsel for the petitioner; Sri A.Abhishek Reddy, Standing Counsel for 1st respondent; Sri D.L.Pandu, Standing Counsel appearing for 2nd respondent, and the Government Pleader for Higher Education appearing for 3rd respondent.

2. Petitioner appeared for the Intermediate Examination in 2016 in MPC stream but managed to get only 19 marks out of 60 marks in the Physics Advanced Supplementary Examination held in May, 2016. She applied for re-verification and re-totaling to the 2nd respondent on 27.06.2016. Apprehending that in the meantime, she would not be considered for admission into Bachelor of Engineering Course in the sports quota and also in NCC quota, for which an entrance test has been conducted by the 1st respondent, this Writ Petition was filed.

3. On 14.07.2016, this Court directed that one seat under the sports quota in Engineering(CS) Course in Jawaharlal Nehru Technological University has to be kept vacant till 21.07.2016.

4. It is stated by the Standing Counsel for the 2nd respondent that in the re-verification/re-totaling declared on 16.07.2016, the petitioner secured 21 marks, which are the requisite pass marks.

In view of the declaration of the petitioner's result pursuant to re-verification and re-totaling on 16.07.2016 by the 2nd respondent and in view of the fact that the petitioner had passed in the said examination, the petitioner is entitled to be considered in the reserved seat under the above quota.

6. The Standing Counsel for the 1st respondent submits that the case of the petitioner will be considered for admission under sports quota in the one seat which has been reserved pursuant to the interim order granted by this Court on 14.07.2016.

7. Therefore, the 1st respondent is directed to consider the case of the petitioner for admission, under the sports quota, in the Engineering (CS) Course in Jawaharlal Nehru Technological University on the basis of the re-verification and re-totaling result declared by the 2nd respondent on 16.07.2016.

8. The Writ petition is allowed accordingly. There shall be no order as to costs.

9. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
