THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6110 of 2018 ORDER:

It is the case of the petitioner that the 4th respondent, who is his neighbour, has established a chilly powder making machine unit, which is causing nuisance and disturbance to him and other neighbours and that they have been suffering enormously. It is also further averred that the 4th respondent had failed to obtain any permission under the A.P. Panchayat Raj Act, 1994 and in spite of the complaint made by him on 20.10.2017, the respondent authorities are not acting on the same.

2) On the other hand, Sri G. Seshadri, learned Standing Counsel for respondents 2 and 3 submits that as per instructions received from the 3rd respondent-Gram Panchayat, there is no complaint received by it. However, if a proper complaint is made to the Gram Panchayat, it will take steps to abate the nuisance, if any, that is being caused by the 4th respondent. 3) In the circumstances of the case, the Writ Petition is disposed of by giving liberty to the petitioners to file objections with the 3rd respondent-Piler Grampanchayat, who shall take into consideration the same and act upon it within four weeks from the date of receipt of such complaint and redress the grievance of the petitioner by ensuring nuisance is abated. No costs. 4) Consequently, Miscellaneous Petitions pending, if any, in this Writ Petition, shall stand closed.
