HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No. 16588 of 2016 ORDER:

Vide present Criminal Petition, the petitioner/Accused No.1 seeks to quash the order dated 31.10.2016 passed in Crime No.223 of 2016 by the learned I Additional Chief Metropolitan Magistrate, Visakhapatnam whereby the petitioner was directed to produce proper sureties as per the directions of learned IV Additional District & Sessions Judge, Visakhapatnam dated 19.10.2016 in order to grant bail to him.

Pursuant to the order of this Court dated 14.12.2016, the Court below was directed to submit a report regarding the status of sureties furnished by the petitioner. Accordingly the learned judge of Court below sent a report dated 23.12.2016. From a perusal of the report furnished by the learned Judge, I do not find any discrepancy in the order of the Court below dated 31.10.2016.

At this stage, the learned counsel for the petitioner seeks permission to withdraw the Criminal Petition with liberty to furnish sound and sufficient sureties before the Court below. Permission is accorded and the Criminal Petition is dismissed as withdrawn with liberty as sought for.
