HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15887 OF 2016 O R D E R :
The case of the petitioner is that she is the owner and possessor of the land admeasuring Ac. 0.58 cents in Sy.No.251/3 along with a saw mill existing in the said land and the same was acquired by the Government in pursuance to the notification issued on 07.12.1995 vide reference C/63/95 and the draft declaration was published on 22.06.1996. Thereafter a supplementary award was passed vide No.1/99-2000, dated 09.09.1999 awarding the petitioner the compensation of Rs.13.93 lakhs. Aggrieved by the inadequate compensation, the petitioner made an application under Section 18 of the Land Acquisition Act, 1894 (for short 'the Act') on 10.10.1999 for referring the matter to the competent Civil Court for enhancement of compensation. Meanwhile, disputes arose between the petitioner's family members regarding the subject property and O.S.No.
42 of 1998 was filed and ultimately the matter was compromised in S.A.No.272/2002. After settlement of the issue, the petitioner approached the 3rd respondent authority seeking reference of her application filed under Section 18 of the Act by filing several applications. But the 3rd respondent failed to refer the matter to the competent Civil Court. Aggrieved by the inaction of the 3rd respondent, the present writ petition is filed.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Land Acquisition. Since it is stated that the application made by the petitioner on 10.10.1999 under Section of the Act is pending before the 3rd respondent, the 3rd respondent is directed to dispose of the same in accordance with law.
With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions,
pending, if any shall stand closed.
