THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CC.No.167 of 2017 ORDER :

This Contempt Case is filed alleging willful disobedience of the order dt.18.10.2016 in WPMP.No.41667 of 2016 in WP.No.33768 of 2016.

The said order reads as under :

"Pending further orders, the 1st respondent-Corporation will constitute a Medical Board to examine the case of petitioner at the earliest, communicate to petitioner the date and time when the petitioner should appear before the said Medical Board, which shall not be more than three (03) weeks from the date of receipt of a copy of this order, and submit the decision of the Medical Board to this Court.

Pending this assessment of the case of petitioner by the Medical Board of the 1st respondent-Corporation, there shall be interim direction to 2nd respondent to pay salary to petitioner till date for the post of conductor. Post after four (04) weeks."

It is not in dispute that after this order is passed, the petitioner was directed to appear before the Medical Board on 29.10.2016, and on 07.11.2016 he appeared before the Medical Board which pronounced him to be unfit to hold the post of a driver. So, this part of the above order is complied with.

No doubt, there is some delay in paying salary to the petitioner. Having regard to the explanation given by the respondent, I do not deem it proper to punish the respondent for Contempt of Court.

Accordingly, the Contempt Case is closed. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Contempt Case, shall stand closed.
