THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASES No. 689 & 726 OF 2018 O R D E R :
Both these Contempt Cases have been filed alleging disobedience on the part of the respondents of the common order dated 28.02.2017 in Writ Petitions No. 17725 and 17765 of 2016. The order dated 28.02.2017 consists of three parts:
1) injuncting the respondent State from interfering with the possession and enjoyment of the petitioners; 2) payment of Rs.25 lacs towards usufruct which has been sold in public auction by the State illegally; and 3) levying costs of Rs.10,000 /- on the 3rd respondent Tahsildar in the Writ Petition who is also the respondent in the Contempt Cases.
Today, it is brought to the notice of this Court that the Division Bench of this Court vide order dated 11.06.2018 in Writ Appeal Nos. 488 and 489 of 2018, while affirming the order dated 28.02.2017 in Writ Petitions No. 17725 and 17765 of 2016, on merits, set aside the direction given with respect to making over of the auction proceeds of Rs.25 lacs to the petitioners. Learned counsel for the respondents submits that the order to the extent of payment of costs has been complied with, which assertion is not disputed by the learned counsel for the petitioners. In the light of the subsequent developments reported, it cannot be said that there is contempt on the part of the respondents.
