THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.16768 OF 2015 ORDER:

The grievance of the petitioner is that the Tahsildar, Dakkili Mandal, SPSR Nellore District, is not taking action upon his complaint with regard to the bore-well sunk by the 5th respondent in Survey

Nos.51/7 and 264/5 of Daggavolu Village, Dakkili Mandal, SPSR Nellore District. The petitioner seems to have made representation on 16.06.2014 in this regard to the Tahsildar.

In the light of the order proposed to be passed by this Court, it is not necessary to put the 5th respondent on notice. Section 15 of the Andhra Pradesh Water, Land and Trees Act, 2002, vests the Tahsildar with the power to take action as regards the operation of any Well. Such action can be initiated even on the basis of a complaint made by the affected party. That being so, the Tahsildar, Dakkili Mandal, SPSR Nellore District, shall consider the petitioner's representation dated 16.06.2014, give notice to all the parties concerned, i.e., the petitioner, the 5th respondent and any other affected party, and pass an appropriate reasoned order in exercise of his powers under Section 15 of the aforestated Act.

This exercise shall be completed expeditiously and in any event, not later than two (2) months from the date of receipt of a copy of this order. The Writ Petition is disposed of with the above directions. Pending Miscellaneous Petitions in this Writ Petition shall stand closed in the light of this final order.
