WRIT PETITION NO. 5894 OF 2012 O R D E R :

The petitioner assails the Notification No.1371 dated 02/9/2009 published in the daily news paper 'The Hindu' on 04/11/2001 under section 3 [A] of the National Highways Act, 1956 as illegal. The subject land of wript petitioner is Ac:01-87 cents in survey No. 650/A/1-A Palempalli village, Kadapa Mandal, Kadapa district.

2. At the time of hearing, the learned counsel for the petitioner submits that to the extent of Ac:01-60 cents in this survey number the petitioner has received compensation and to that extent the cause does not survive. As regards the balance extent of Ac:0-27 cents in survey No.650/A/1-A is concerned, having regard to the stand taken by the respondents, he requests the court to reserve the right of petitioner to pursue the legal remedies as and when cause arises.

3. The writ petition is dismissed by granting the liberty as prayed. No order as to costs.

4. As a sequel, Miscellaneous Petitions if any, pending in

this writ petition shall stand closed.
