HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.13822 of 2016 ORDER :

Heard the learned counsel for the petitioner/ accused and also the respondent-State represented by the learned Assistant Public Prosecutor and perused the material on record of the Crime No.105 of of Nawabpet Police Station, Mahaboobnagar on 01.08.2016 for the offences punishable under Section 306 and 498-A I.P.C, basing on the statement of the deceased no other than the wife of the accused.

The facts in fact falls short for this Court at this stage to nip at the bud of the further investigation, but for the investigation shall go on and in the mean time instead of keeping the matter pending, giving disposal from the entitlement of the concession of bail, to surrender before the learned Magistrate concerned and with affidavit of surrender of even date, move for regular bail before the learned Sessions Judge concerned with notice to the Public Prosecutor in such an event the learned Sessions Judge shall grant bail if not on same day, atleast by next day with necessary conditions. Needless to say for any further remedy, it is left open to the petitioner to approach this Court after completion of investigation.

2) With the above observations, the Criminal Petition is disposed of.

3) Miscellaneous petitions, if any pending, shall stand closed.
