THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1447 OF 2014 ORDER:

This Criminal Petition is filed by the accused under Section 482 of Cr.P.C. seeking to quash the proceedings in C.C.No.583 of 2012 pending on the file of VII Additional Judicial First Class Magistrate, Rajahmundry for the offence under Section 498-A IPC and Sections 3 & 4 of Dowry Prohibition Act. As far petitioners 1 to 5 herein are concerned, the Criminal Petition is dismissed as withdrawn as per orders of this Court dated 17.2.2014.

Heard and perused the material available on record. As far as petitioners 7 & 8-A.7 and A.8 are concerned, as seen from the charge sheet, the allegation against them is that while the A.1's family members were in search of alliance, A.7 and A.8 brought the match of L.W.1. Except the allegation that they introduced the complainant to the other accused, there is no other allegation against them so as to attract the offences alleged. Hence, the impugned proceedings as against A.7 and A.8 are liable to be quashed. As far as A.6 is concerned, there are prima facie allegations against her and the truth or otherwise of the same has to be decided by the trial Court after full-fledged trial. However, considering the fact that A.

6 is lady, her presence before the trial Court is dispensed with except on the dates so specifically the trial Court insists for her appearance. She is directed to be represented by a counsel on all hearing dates. Accordingly, the Criminal Petition is allowed as against petitioners No.7 & 8-A.7 & A.8 and the impugned proceedings are quashed against them.

as against petitioner No.6-A.6.

Consequently, miscellaneous petitions, if any, pending, shall stand closed.
