THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.8149 of 2015 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/A-4 in Crime No.218 of 2015 of Pahadishareef Police Station, Cyberabad, Ranga Reddy District, registered for the offences punishable under Sections 420, 448, 471 and 506 IPC read with Section 34 IPC and Sections 3 and 4 of A.P. Land Grabbing Act.

Heard the learned counsel for the petitioner/A-4 and the learned Public Prosecutor and perused the material on record. The offences alleged against the petitioners are punishable under Sections 420, 448, 471 and 506 read with Section 34 IPC and Sections 3 and 4 of A.P. Land Grabbing Act. Admittedly, on a complaint being lodged by the second respondent/de facto complainant before the concerned Magistrate, the Magistrate referred the same under Section 156 (3) Cr.P.C. to the concerned police station for investigation and report and basing on such reference, the police registered the above crime for the alleged offences and the case is under investigation.

Having regard to the facts and circumstances of the case and also in view of the nature of offences alleged against the petitioner are serious in nature, this Court is not inclined to interfere with the proceedings against the petitioner/A-4. However, the Police concerned is directed to complete the investigation without arresting the petitioner/A-4 and file final report in accordance with law.

purpose of investigation and on receipt of such notice, the petitioner/A-4 shall appear before the police and cooperate with the investigating agency. In the event of failure on the part of the petitioner/A-4 to appear before the police on receipt of such notice, the police are at liberty to approach this Court for recalling the present order.

With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
