THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6096 of 2018 ORDER:
This Writ Petition is filed challenging the action of respondents 2 to 4 in not disposing of the representation of the petitioner, dated 02.01.2018, for protecting burial ground in Survey Nos.402, 403/A, 403/B and 404, situated at Bankingharm Channel, Mypadu Village, SPSR Nellore District.

Learned Government Pleader obtained written instructions, which state that the land to an extent of Ac.1.00 cents, out of Ac.4.16 cents in Survey No.404 of Mypadu Village, was allotted to the Fisheries Department for drying the fish. The Fisheries Department constructed a pucca building and erected a compound wall. The remaining extent of Ac.3.16 cents is covered with full of shrub growth and old tombs are existing. The Tahsildar, however, stated that the land was visited by him along with field staff and observed that nobody destroyed the old tombs and shrub growth. The petitioner is not the President of community, but one Mavilla Jayaramaiah is the President of Bestha community. The land in Survey Nos.402, 403-A and 403-B is classified as private patta land, whereas land in Survey No.404 is a village poramboke. The burial ground of Bestha community existing at a distance place.

In view of above facts, no further orders required in the Writ Petition and accordingly, the Writ Petition is closed. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
