THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 5989 of 2012 ORDER:

Both the learned counsel appearing for the parties agree that the issue arising herein fell for consideration before this Court in W.P.No.17998 of 2012 and the decision rendered therein squarely covers the matter. A copy of the order dated 15.11.2012 passed by this Court in W.P.No.17998 of 2012 is placed on record.

In terms of the aforestated order and for reasons alike as were mentioned therein, this Writ Petition is disposed of directing the respondent authorities not to levy any penalty in case the sand utilised by the petitioner in the works executed by it has already suffered seigniorage fee and proof of payment thereof by way of deduction from the bills is produced before the Assistant Director of Mines and Geology concerned.

Pending Miscellaneous Petitions shall stand closed in the light of this final order. No order as to costs.
