f ...RESPONDENT/COMPLAINANT Petition under Section 438 of Cr.P.C praying that in the circumstances stated in the Memorandum of Grounds of Criminal Petition, the High Court may be pleased to grant Anticipatory bail by directing the Respondent to release the Petitioner/Accused in the event of arrest, in the above crime No. 22 of 2023 on the file of P.S. Kamanpur, Peddapalli District. This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri NABI RASOOL BALADUR, Advocate for the Petitioner and the Public Prosecutor on behalf of the Respondent No.1 and of none appeared for the Respondent No. 2. The Court made the following: ORDER

HONBLE DT. JUSTICE CHILLAKUR SUMALATHA CRIMINAL PETITION No.2748 of 2023 ORDER:

Heard Sri Nabi Rasool Baladur, Iearned counsel for the petitioner, as well as learned Additional Public Prosecutor who is representing the respondent-State 2.

Seeking pre-arrest bail, the present Criminal Petition is filed under Section 438 Cr.P.C. on behalf of the petitioner, who is arrayed as accused in Crime No.22 of 2023 of Kamanpur Police Station, Peddapalli District. 3.

Contending that the petitioner has not committed any offence whatsoever and projecting the ground of ill-health of the petitioner, learned counsel for the petitioner claims anticipatory bail.

4. On the other hand, the learned Additional Public Prosecutor submits that the petitioner has cheated innocent women and misappropriated huge amount. Learned Additional Public Prosecutor further submits that eleven (11) witnesses were examined till now and all the witnesses spoke

As per the contents of the complaint' the petitioner is theleaderofoneoftheMahilaGroups.ThesaidMahila Group members gave their earnings to the petitioner to clear off the loan of Rs.3,55,000/-' However' the petitioner did not deposit the said amount into the bank account and she made personal use of the said amount' When the Group members pressurized the petitioner, she left the village ' On that' the Group members approached the village elder and the petitioner was secured and the petitioner gave "i, undertaking that she would clear off the loan' She paid some amount, but she again absconded leaving the outstanding ba-lance of Rs.2,8 1,000/ -.

Thus, the contents of the complaint reveal grave allegations against the petitioner' Also, by the submission of the learned Additional Public Prosecutor, it is clear that the material witnesses spoke against the petitioner and the case is still under investigation.

Having considered these facts and the aliegations levelled, this Court is of the view that the request of the petitioner cannot be considered.
