HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.3827 OF 2017 ORDER:
The present Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973, requesting to grant anticipatory bail.
2. The petitioner is arraigned as accused No.2 in Crime No.110 of 2017 of V.M. Banjara Police Station, Khammam District, State of Telangana, and he along with other accused alleged to have committed the offence punishable under Section 384 IPC.
3. Heard Sri B. Muralidhar, learned counsel for the petitioner and learned Additional Public Prosecutor for the State of Telangana.
4. The learned counsel having made submissions on merits of the case, however, would submit that all other accused persons were arrested and released on bail, and a direction be given for disposal of bail application, on his surrender, on the same day by the concerned Magistrate. The submission made by the learned counsel appears to be reasonable as all other accused were already enlarged on bail.
5. Therefore, the petitioner is directed to surrender before the Additional Judicial Magistrate of First Class, Sathupalli, and make an application for grant of regular bail, and in case he files such an application, the learned Magistrate shall consider and dispose of the same on its own merits on the same day in accordance with law.
