THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.19458 OF 2014 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the action of the respondents in not disposing of the application, dated 4.2.2014, of the petitioner in accordance with G.O.Ms.No.7, Animal Husbandry, Dairy Development and Fisheries (Fish.II) Department, dated 16.3.2013, as illegal and arbitrary and consequently, to direct respondent No.1 to dispose of the said application forthwith.

When the matter is called, none appears for the petitioner and there is no representation on his behalf. 3.

On 14.7.2014, this Court, while admitting the writ petition, passed an interim order in W.P.M.P.No.24365 of 2014 as follows: "Heard the learned counsel for the petitioner. The grievance of the petitioner is that the petitioner was already granted permission for conducting Fresh Water Aquaculture/Prawn Culture, which is expired on 07-09-2013, and the petitioner made an application on 04-02-2014 for renewal of registration of Fresh Water Aquaculture Farm, which is pending and no orders are passed thereon. Pending the said application, the petitioner intends to make repairs and maintenance works to the fish tanks.

In view of the same, the petitioner is permitted to carry out repairs as well as maintenance works as per clause 7.23 of G.O.Ms.No.7, dated 16-03-2013 to the fish tanks in an extent of Ac.27.06 cents in Sy.Nos.29 and 159 of Satyavolu village, Pedapadu Mandal, West Godavari District. The respondents are also directed to dispose of renew application as per law."

Learned Government Pleader for Fisheries stated that as per the direction given by this Court on 14.7.2014, the application of the petitioner has already been considered by the concerned authority and hence, the cause in this writ petition does not survive and therefore, no further orders are required to be passed in this Writ Petition.

Recording the same, the Writ Petition is disposed of as infructuous. There shall be no order as to costs. 5.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
