HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.41609 OF 2016 ORDER:
The case of the petitioners is that petitioners filed O.S.No.51 of 2015 seeking declaration of title and recovery of possession of 46 sq.yards. Along with the said suit I.A.No.363 of 2015 is filed seeking permanent injunction but the same could not be disposed of due to absence of Presiding Officer. But the respondent authorities are now trying to make constructions in the said property. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue. It is to be seen that, it is not the case of the petitioners that any incharge arrangements are not made. Therefore, the petitioners can avail their remedy in I.A.No.363 of 2015. However, the status-quo order granted by this Court on 05.12.2016 will be in operation for a period of four weeks from today. The Civil Court shall dispose of the above said I.A. without being influenced by this order. When once incharge arrangements are made it goes without saying that the said office has to take up urgent matters and dispose of the same.
With the above direction, the writ petition is disposed of. No costs. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. _________________________ A.RAJASHEKER REDDY,J 02.02.2017 Note:
