HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.369 of 2016 ORDER:
This revision is preferred challenging the docket order passed in Crl.M.P.No.7 of 2016 in C.C.No.32 of 2015 on the file of the III Additional Judicial Magistrate of First Class, Nellore, wherein the learned Magistrate dismissed the petition filed by the petitioner to recall the N.B.W.
The learned counsel for the petitioner - accused submitted before this Court that petitioner - accused is ready to face the trial and she will not flee from the hands of justice. Having heard the learned counsel for the petitioner and the learned Public Prosecutor and having perused the material available on record, this Court is of the view that the revision can be disposed of with the following directions : The petitioner - accused is directed to surrender before the Court concerned and file a petition to recall the warrants issued against her and on such filing of a petition, the trial Court is directed to recall the warrants on the same day on her execution of a bond for a sum of Rs.5,000/- (Rupees Five thousand only) with one surety for a like sum and further the petitioner - accused is directed to appear before the trial Court regularly.
Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
