SMT. JUSTICE T. RAJANI CRIMINAL PETITION No.6815 OF 2013 ORDER:
Petitioners herein, who are accused Nos.2 and 3 in Cr.No.357 of 2012 on the file of P.S., Arundalpet, Guntur, registered for the offence under Section 304-B IPC, filed the present petition under Section 482 of the Criminal Procedure Code, 1973, to quash the proceedings in P.R.C.No.16 of 2013 on the file of the V Additional Junior Civil Judge, Guntur.
Heard learned counsel for the petitioners and the learned Public Prosecutor appearing for the 1st respondent-State. None appears for the 2nd respondent despite service of notice. A perusal of the complaint shows that absolutely no allegations are made against the petitioners and all the allegations are directed only against the son-in-law of the complainant. There is not even a whisper about the petitioners herein in the complaint. Hence, in the above circumstances, continuance of the proceedings against the petitioners would result in abuse of process of law. Accordingly, the criminal petition is allowed and the proceedings against the petitioners in P.R.C.No.16 of 2013 on the file of the V Additional Junior Civil Judge, Guntur, are quashed. As a sequel, miscellaneous petitions, if any pending, stand closed.
