ORDER
This Criminal Petition is filed praying this Court to grant pre-arrest bail to the petitioner, who is arrayed as accused No.9 in Crime No.87 of 2025 before the EOW Police Station, Cyberabad Commissionerate, registered for the
offences punishable under Sections 318(4), 319(2), 336(3), 338, 340(2), 351(3) read with 61(2) of BNS.

The brief facts of the case are that accused No.1, along with accused Nos.2, 7 and 8, conspired to grab Plot No.28 admeasuring 700 square yards in Sy.No.91 of Gachibowli Village belonging to the de facto complainant. It was alleged that the accused created a forged GPA by fabricating the complainant's Australian address and passport details, and on the strength of the said forged GPA, accused Nos.1 and 2 allegedly secured its validation before the District Registrar by paying illegal gratification of Rs.25 lakhs to accused No.3. Based on the validated GPA, accused No.1 executed a sale deed in favour of accused No.2, and the documents were allegedly handed over to accused No.8 for disposal of the property. The allegation against the petitioner rested solely on the confessional statement of accused No.7, who claimed that he paid Rs.1,25,000/- to the petitioner for preparing a fake Australian address of the de facto complainant. 3.
Heard Sri P.Durga Rao, learned counsel appearing on behalf of the petitioner as well as Sri Ramachandra Reddy,
learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that except for the alleged confession of accused No.7, there was no material in the remand report showing the involvement of the petitioner in creation of the forged GPA, its validation, execution of the sale deed, or receipt of any sale consideration. He further submitted that no date or time was mentioned regarding the alleged preparation of the false address and that the petitioner neither knew the complainant nor any of the other accused persons. He averred that subsequent to dismissal of earlier bail petitioner, new sale deeds of subject property were executed, and therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. Further, the investigation was not yet completed. At this stage, granting of pre-arrest
bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

Having regard to the rival submissions and material on record, it is noted that in view of changes circumstances of execution of new sale deeds pertaining to subject property, this Court deems it fit to grant pre-arrest bail to the petitioner subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, EOW Police Station, Cyberabad, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the
Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
