THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.7932 of 2017 ORDER:

This criminal petition is filed by the sole accused, under Sections 437 and 439 of Cr.P.C., seeking bail in Crime No.132 of 2017 on the file of the Station House Officer, Prohibition & Excise Station, Balanagar, for the offence punishable under Section 8(c) read with 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor representing the State. 3.

The case of the prosecution is that on 02.7.2017, the Prohibition & Excise Officials, Balanagar, seized 3.150 Kgs of Ganja from the possession of the petitioner. The further case is that the petitioner is selling Ganja. After completion of necessary formalities, the case was registered. 4.

The petitioner filed Crl.M.P.No.3330 of 2017 on the file of the Court of Metropolitan Sessions Judge, Cyberabad at L.B. Nagar, under Section 439 of Cr.P.C., and the same was dismissed on 24.8.2017, on the ground that the investigation is in progress.

The learned Additional Public Prosecutor submitted that the investigation is still in progress. In view of the pendency of investigation, this court is of the view that this is not a fit case to grant bail to the petitioner.

Accordingly, the criminal petition is dismissed.
