ORAL ORDER:

Heard the learned counsel for petitioners, learned Government Pleader for Social Welfare and Sri B Ravindranath, learned standing counsel for 5th respondent.

Petitioners are aggrieved by the decision of Agency Divisional Officer/Revenue Divisional Officer-third respondent herein dated 27.8.2018 in LTR Case No. 4/2017/TKP. By this order, the Agency Court ordered ejectment against the petitioners or whoever is in possession of the property and directed that schedule property be restored to tribal petitioner or his legal heirs. 3.

Against decision made by the Agency Divisional Officer, remedy of appeal is available before the Agent to Government. Without availing the said remedy of appeal, straightaway this writ petition is filed. Since, petitioners have effective remedy in the form of appeal, Court is not inclined to entertain the writ petition. Accordingly, writ petition is dismissed leaving it open to petitioners to avail the remedy of appeal, if so advised. No costs. Miscellaneous petitions, if any pending, are closed.
