HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18198 OF 2016 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the 2nd respondent in not surveying the private land of the petitioner for Sub Division and Demarcation of the same, pursuant to the payment of necessary charges of Rs.285/- through AP Online on 05.02.2016, as illegal and arbitrary and for a consequential direction to the 2nd respondent to conduct survey and make Sub Division and demarcate the land of the petitioner admeasuring Ac.2.06 cents in S.No.194/1, situated at Thottambedu Village & Mandal, Chittoor District, as per RSR and its Field Map, within four weeks.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Revenue produced written instructions wherein it is stated that the Mandal surveyor has given an endorsement to the petitioner stating that the petitioner is not in enjoyment of the land in S.No.194/1B to an extent of 0.59 cents, and there is no sub division pertaining to 0.59 cents and the petitioner has not shown any documentary evidence showing that the lands belong to him. It is further stated that the entire land in S.No.194/1, admeasuring an extent of 2.06 cents is covered by way of house site plots and some portion is covered by dwelling Rice Mill.

Heard both sides.

In similar circumstances, this Court by order dated

20.04.2016 allowed WP.No.91 of 2013 and batch. In view of the same, the respondents are directed to dispose of the application dated 05.02.2016, filed by the petitioner seeking survey of the land, in terms of the aforesaid order and communicate the same to the petitioner within a period of four (4) weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
