HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.190 of 2016 ORDER:
This petition is filed to transfer O.P.No.22 of 2015 from Senior Civil Judge, Huzurabad, Karimnagar, to Family Court, Warangal.
2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 22.05.2011 as per Hindu rites and custom at K.R. Gardens, Deshaipet, Warangal. She stated after marriage she joined respondent at his house and thereafter they were blessed with a male child.
She further stated that respondent developed negative attitude towards her and harassed on one reason or the other and due to harassment she made a complaint to Women Police Station and thereafter she filed M.C.No.50 of 2015 before Family Court, Warangal, which passed a order on 17.12.2015. She stated that respondent filed O.P. for divorce with false averments.
She stated that she apprehend danger to her life at Huzurabad, Karimnagar District. She further stated that she cannot travel alone from Warangal to Huzurabad in view of the apprehension, for that reason, she sought transfer of O.P.No.22 of 2015 from Senior Civil Judge, Huzurabad, Karimnagar, to Family Court, Warangal.
3. This Court permitted petitioner to take personal notice to respondent through registered post with
acknowledgment due and in compliance of the said order, registered notice was sent to respondent and as per the track report of the Postal Department, the registered notice was booked on 06.04.2016 and was delivered on respondent on 09.04.2016. In spite of service of notice respondent neither appeared in person nor through any advocate.
4. Heard advocate for petitioner.
5. Considering the reasons stated in the affidavit filed in support of petition, O.P.No.22 of 2015 is withdrawn from Senior Civil Judge, Huzurabad, Karimnagar, and transferred to Family Court, Warangal, for disposal in accordance with law.
6. Accordingly, this transfer C.M.P. is ordered.
7. Miscellaneous petitions pending, if any, shall stand closed.
