Heard.

The grievance of the petitioner is that the 7th respondent obtained bogus certificate from the revenue authorities and on the strength of the same, he contested in the election as Ward Member and got elected.

Learned counsel for the petitioner has produced certain documents to show that there are several contradictions and that the said issue has been referred by way of representations to respondents 1 to 6 and since respondents 1 to 6 have not considered the representations dated 16.01.2019 and 29.01.2019 respectively, the petitioner approached this Court under Article 226 of the Constitution of India. It is further submitted that one Md. Abdul Aijaz Khan also obtained bogus certificate from the 5th respondent and got elected as Ward Member from Ward No.2 and aggrieved thereby, W.P.No.3457 of 2019 was filed by one Abdul Raheem and the same was disposed of directing the District Collector to examine the claims and counter claims of both sides after affording opportunity to decide the matter.

In the light of the above, this writ petition is also disposed of directing the 3rd respondent to hear both the parties, dispose of the representations filed by the petitioner and pass appropriate orders within two months from the date of receipt of a copy of this order after affording opportunity to both the parties. No costs. Miscellaneous petitions, if any, pending in this petition shall stand closed.
