THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 32749 OF 2017 O R D E R:
This Writ Petition has been filed seeking a mandamus to declare the action of the 1st respondent State of Telangana in not passing an appropriate Government Order in favour of the petitioners, under Section 20 of the A.P. Education Act, 1982, pursuant to the recognition granted by the NCTE for the academic year 2016-17 and the consequential act of the 3rd respondent Telangana University in not granting affiliation to petitioner institution and not including it in the process of counselling for allotment of students in B.P.Ed. course for the academic year 2017-18, as arbitrary and illegal.
Heard Smt. G. Jhansi, learned counsel for the petitioner, Sri A. Abhishek Reddy, learned Standing Counsel for Respondents 2 and 4, learned Government Pleader for Higher Education (Telangana) for Respondents 1 and 5 and Sri Krishna Murthy, learned Standing Counsel for the 3rd respondent. It is submitted at the Bar that the issue raised in the present Writ Petition is squarely covered by the judgment dated 16.09.2016 of this Court in Writ Petition No. 26870 of 2016 and batch. It is also brought to the notice of this Court that the said Order of the learned Single Judge was confirmed in Writ Appeal No. 1047 of 2016 and further, the Special Leave Petition filed thereagainst also came to be dismissed by the Supreme Court. Thereafter, in case of the writ petitioners therein, the State had granted permission and issued necessary Government Orders.
This aspect of the matter is not disputed by the learned counsel appearing for the parties.
In those circumstances, the Writ Petition is disposed of with a direction to the 1st respondent to consider the case of the petitioner in terms of para 20 of the judgment of the learned Single Judge in Writ Petition No. 26870 of 2016 and batch, dated 16.09.2016, for the academic year 2017-18, and take necessary decision within a week from the date of receipt of a copy of this order. No costs.
Consequently, the miscellaneous Applications, if any shall stand closed.
